Acceptance of these terms
By using our website or downloading and using any app published by Utopia Trail Limited (“Utopia Trail”, “we”, “us”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.
Who can use our services
You must be old enough to form a binding contract where you live, or have the permission of a parent or guardian. Our apps are not directed to children under 13.
Our license to you
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to install and use our apps on devices you own or control, for your own non-commercial use, in line with these terms and the rules of the app store you downloaded the app from.
Acceptable use
You agree not to:
- copy, modify, sell, rent or distribute our apps, except as the law allows;
- reverse engineer or try to extract the source code of our apps;
- use our services to break the law or infringe the rights of others;
- upload malware or interfere with our services, servers or security;
- use our services in a way that is abusive, harmful or fraudulent.
Your content
You keep ownership of the files, text and other content you use in our apps. You give us permission to process that content only as needed to provide the features you choose. You are responsible for making sure you have the right to use that content.
AI-powered features
Some apps include features that generate text, images or suggestions using artificial intelligence. Results may be inaccurate, incomplete or unsuitable. Check important results before relying on them, and do not treat them as professional advice.
Purchases and subscriptions
Some features may require payment or a subscription. Purchases are handled by the app store you use, and its payment terms, billing, refund and cancellation rules apply. You can manage or cancel subscriptions in your app store account settings.
Third-party services
Our apps may work with services provided by others, such as app stores, advertisers or cloud providers. Those services have their own terms, and we are not responsible for them.
Intellectual property
The apps, website, logo, name and all related content are owned by Utopia Trail or its licensors and are protected by intellectual property laws. These terms do not give you any right to use our brand or trademarks. If you send us feedback or suggestions, we may use them without obligation to you.
Disclaimers
Our services are provided “as is” and “as available”. To the fullest extent the law allows, we do not promise that they will be uninterrupted, error-free or fit for a particular purpose.
Limitation of liability
To the fullest extent the law allows, Utopia Trail is not liable for indirect, incidental or consequential losses, or for loss of data, profits or goodwill arising from your use of our services. Nothing in these terms limits liability that cannot be limited by law.
Suspension and termination
You can stop using our services at any time by uninstalling the apps. We may suspend or end your access if you break these terms or if we need to do so for legal or security reasons.
Changes to these terms
We may update these terms from time to time. We will post the new version here with a new date. Continuing to use our services after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have exclusive jurisdiction over any dispute, unless the law where you live gives you rights that cannot be waived.
